Welcome to Team Haas Judo Jiu-Jitsu Online Training. This is a subscription-based service that provides our members with Judo and Jiu-Jitsu instructional videos that are streamed over the internet and viewable on the web on a variety of devices. Our service is intended to be used by practicing Judo and Jiu-Jitsu students, who train in a professional environment, as a means of supplementing their existing instruction. Judo and Jiu-Jitsu should never be practiced without direct supervision from a qualified instructor in a proper environment. We'll use some terms interchangeably; in particular, "Service", "THJJJ", "teamhaasjudo.com", and "Team Haas Judo Jiu-Jitsu LLC" all equally represent the entity which embodies all features and functionality, media, website, software and user interfaces of our online Judo and Jiu-Jitsu program. These Terms of Use govern your use of the service. If you do not agree to the terms in part or whole, your sole remedy is to discontinue use of the service. By continuing to use the service, you have accepted these terms and agree to be bound by them. By agreeing to these Terms of Use, you represent that you are at least the majority of age in your state or province, or you are the age of majority in your state or province and you have given us your consent to allow any of your minor dependents to use the service. If you reside within US jurisdiction, the minimum age to subscribe to our service is 18 years. Outside of the US, the minimum age to subscribe is subject to the laws of your province, territory or country, with regard to the minimum age to enter into a binding agreement. Those under 18 years may use the service only if the service is established by a parent or legal guardian. Your paid subscription will continue on a recurring basis, based on the signup Date of Purchase, and automatically renew until cancelled or terminated. You must cancel your membership via email notification no less than 7 business days prior to the renewal date to avoid being charged the next recurring payment. By subscribing to our service, you authorize us to charge a recurring fee for your subscription plan to your preferred method of payment until your membership is cancelled. The frequency and amount of each payment is based on your chosen billing plan. The day your payment falls on is generally the same calendar day as your commencement payment, though the day may change if there is a billing error or the day falls on a non-repetitive day of the month; for example, the 31st. Log into your account to see the exact date of your next payment. As a subscriber, you are required to have at least one payment method on your account. If your primary payment method is declined or no longer valid, you authorize us to charge the remaining available payment methods. If payment is unsuccessful, access to your account may be temporarily suspended until we are able to successfully charge a payment method. You remain responsible for any uncollected amounts. You may cancel your subscription at any time. Unless otherwise requested, you will continue to have access to the service through the current billing period. When your account is cancelled, your account will automatically close at the end of the current billing period. Refunds and credits are not issued for remaining unused time. You must cancel your account via email notification no less than 7 business days prior to the next billing date. All subscription payments are final and non-refundable. Account cancellations are non-refundable; however, you will continue to have access until the end of your current billing period. We may issue a refund, credit or some other consideration, at our sole and absolute discretion, and without obligation to provide one again in the future. We may, at any time, in any manner and at our sole discretion, make changes to our offerings in terms of pricing, plans, services or features. Such changes will be announced to existing members prior to them taking effect. We reserve the right to terminate your account without prior notice or compensation if we believe you are violating these Terms, or are engaged in illegal or improper use of the service. The service is made available solely for your personal and non-commercial use. By subscribing to our service, you are granted a limited, non-exclusive, non-transferable license to access our service and view media solely through the website and apps provided for that purpose. You may not modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the content, in whole or in part. You agree to resolve any dispute or claim arising out of the use of our service through binding arbitration or in small claims court. These Terms of Use shall be governed by and construed in accordance with the laws of the state of Texas, U.S.A. with venue in Cedar Park, without regard to conflict of laws provisions. These terms will not limit any consumer protection rights that you may be entitled to under the laws of your state of residence. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect. THE THJJJ SERVICE AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE THJJJ SERVICE, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TEAM HAAS JUDO JIU-JITSU LLC, IT'S AFFILIATES, SUPPLIERS, LICENSORS AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, NEITHER WE NOR OUR SUPPLIERS, AFFILIATES, LICENSORS OR AGENTS MAKE ANY WARRANTY THAT
TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL TEAM HAAS JUDO JIU-JITSU LLC, OR ITS SUBSIDIARIES OR ANY OF THEIR SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR LICENSORS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER. USE OF THE SERVICE IS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS OF USE SHALL AFFECT ANY NON-WAIVABLE STATUATORY RIGHTS THAT APPLY TO YOU. You agree to indemnify, defend and hold harmless Team Haas Judo Jiu-Jitsu LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Use or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. We reserve the right, at our sole discretion, to add to, modify or replace any part of these Terms by posting updates and changes to our website.
